Welcome to Miss Beauty. These Terms of Service (“Terms”) govern your use of the website missbeautyla.com (the “Site”) and the services, treatments, and products provided by Miss Beauty CH, a DBA of Inspired Minds LLC (“Miss Beauty,” “we,” “us,” or “our”). By using our Site or booking any service with us, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Who Can Use Our Services
You must be at least 18 years old to book services or purchase products on our Site. Clients under 18 must be accompanied by a parent or legal guardian who provides consent before any service is performed. Some treatments are not available to minors at all, at our sole discretion.
2. Booking and Cancellation
Booking
Appointments may be booked through our online booking system, by phone, or in person. A confirmation will be sent by email or text. Submitting a booking request does not guarantee an appointment until you receive confirmation from us.
Deposits
Some services may require a deposit at the time of booking. The deposit is applied to the cost of your service. If a deposit is required, this will be disclosed before you confirm your booking.
Cancellations and rescheduling
We ask for at least 24 hours notice if you need to cancel or reschedule. Cancellations made with less than 24 hours notice, or no-shows, may result in:
- Forfeiture of any deposit paid.
- A cancellation fee of up to 50% of the service price.
- Full charge of the service price for repeat no-shows.
Late arrivals
If you arrive more than 10 minutes late, we may need to shorten or reschedule your appointment to avoid affecting other clients. The full service price still applies.
3. Health and Safety
Many of our treatments involve products and devices that can interact with skin conditions, allergies, medications, or recent procedures. To keep you safe, you agree to:
- Disclose all known allergies, sensitivities, medical conditions, recent skin treatments, and medications, including topical or oral retinoids and any recent cosmetic procedures performed elsewhere.
- Inform us if you are pregnant, nursing, or have any condition that may affect your treatment.
- Follow pre-treatment and post-treatment instructions provided by our staff.
We reserve the right to refuse, modify, or stop any service if we believe it is not safe or appropriate for you. Miss Beauty is a beauty and personal care business, not a medical or medi-spa facility. Our services are non-medical in nature and are not intended to diagnose, treat, or cure any medical condition. If you have a medical concern, please consult a licensed healthcare provider.
4. Pricing and Payment
Prices for services and products are listed on our Site or provided at the time of booking. Prices are subject to change without notice, but the price quoted at booking will apply to your scheduled appointment.
Payment is due at the time of service unless otherwise agreed. We accept the payment methods displayed at checkout or in person. All sales are processed in U.S. dollars.
5. Refunds
Services
Because services are personally performed and time is reserved exclusively for you, all service sales are final. If you are not satisfied with a service, please tell us within 7 days of your appointment so we can try to make it right.
Retail products
Unopened retail products may be returned within 14 days of purchase with a receipt for store credit. Opened products are non-refundable for hygiene reasons, except where required by law or in the case of a verified product defect.
Third-party brand products
Products purchased through a third-party brand's retail link offered by us are subject to that manufacturer's return policy, which may differ from our in-person retail policy.
6. Gift Cards and Promotions
Gift cards are non-refundable and cannot be redeemed for cash, except where required by California law. Promotions and discounts may have additional terms, including expiration dates and limits on combination with other offers. We will disclose those terms at the time of the promotion.
7. Use of the Site
You agree to use the Site only for lawful purposes. You may not:
- Use the Site in any way that could damage, disable, or impair it.
- Attempt to gain unauthorized access to any part of the Site or our systems.
- Use any automated tool to scrape or copy content from the Site, except for normal search engine indexing.
- Submit false, misleading, or harmful information through any form, booking, or chatbot.
- Use the Site or our services in a way that violates the rights of others.
8. Intellectual Property
All content on the Site, including text, graphics, logos, photos, treatment descriptions, and the Miss Beauty name and brand, is owned by or licensed to Miss Beauty and is protected by copyright, trademark, and other laws. You may view and share content for personal, non-commercial purposes. Any other use, including reproduction, modification, distribution, or commercial use, requires our written permission.
9. User Content and Reviews
If you submit photos, reviews, testimonials, or other content to us, you grant Miss Beauty a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with our marketing and operations, including on our website and social media accounts. You represent that you own or have the rights to the content you submit and that it does not violate the rights of any third party.
If you do not want your before-and-after photos or other identifiable images used for marketing, please tell us in writing before your appointment or at the time the photos are taken.
10. Third-Party Services and Links
Our Site may contain links to third-party websites, including booking platforms, social media, and partner brand retail shops. We do not control these third-party services and are not responsible for their content, policies, or practices. Using a third-party service is at your own risk and subject to that third party's terms and privacy policy.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and our services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any specific treatment or service result will be achieved.
12. Limitation of Liability
To the fullest extent permitted by law, Miss Beauty, its parent entity, owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site, our services, or our products. Our total liability for any claim arising out of or relating to these Terms or your use of our services will not exceed the amount you paid to us in the 6 months before the event giving rise to the claim.
Nothing in these Terms limits any liability that cannot be limited under California law, including liability for gross negligence, intentional misconduct, or personal injury caused by our negligence.
13. Indemnification
You agree to defend, indemnify, and hold harmless Miss Beauty and its owners, employees, and contractors from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site or our services, or your violation of the rights of any third party.
14. Dispute Resolution
We hope to resolve any concern directly with you. If you have a dispute with us, please contact us first using the information in Section 18 so we can try to resolve it informally.
If we cannot resolve a dispute informally within 30 days, you and Miss Beauty agree to resolve it through binding individual arbitration administered by JAMS in San Bernardino County, California, under the JAMS Streamlined Arbitration Rules. Each party will bear its own costs, except as otherwise required by the arbitrator or applicable law.
This arbitration agreement does not apply to:
- Claims that qualify for small claims court in California.
- Claims for injunctive or equitable relief related to intellectual property.
- Any claim that cannot be required to be arbitrated under applicable law.
To the extent permitted by law, you and Miss Beauty agree that disputes will be resolved on an individual basis and not as part of a class or representative action.
15. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. For any matter not subject to arbitration or small claims court, you and Miss Beauty agree to the exclusive jurisdiction of the state and federal courts located in San Bernardino County, California.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated version on our Site and update the “Last updated” date. Your continued use of the Site or our services after the updated Terms are posted means you accept the changes.
17. Severability and Entire Agreement
If any part of these Terms is found to be invalid or unenforceable, the rest will remain in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Miss Beauty regarding the Site and our services and replace any earlier agreements on the same subject.
